Please read these Terms and Services ("Terms," "Agreement") carefully before purchasing from or using the LumiPep website. By placing an order, subscribing to any plan, or otherwise using our services, you agree to be legally bound by these Terms in their entirety.

1. Acceptance of Terms

By accessing or using the LumiPep website (lumipep.com), placing any order, or subscribing to any service offered by LumiPep ("Company," "we," "our," "us"), you ("Customer," "Subscriber," "you") agree to be bound by these Terms and Services, our Privacy Policy, and all applicable laws and regulations. If you do not agree with any part of these Terms, you must not use our website or purchase our products.

2. Research Use Only — Mandatory Disclaimer

THIS IS THE MOST IMPORTANT SECTION OF THESE TERMS. PLEASE READ IT CAREFULLY.

2.1 All peptides, compounds, chemicals, and related products ("Research Compounds") sold by LumiPep are intended EXCLUSIVELY for in-vitro (outside the body) scientific research and laboratory use by qualified professionals in controlled laboratory environments.

2.2 LumiPep Research Compounds are NOT approved, intended, or suitable for human consumption, ingestion, injection, inhalation, topical application, or any other form of human use. They are also not intended for veterinary use or administration to any living organism.

2.3 LumiPep Research Compounds have NOT been evaluated by the Food and Drug Administration (FDA) or any other regulatory agency for safety, purity, efficacy, or fitness for any purpose in humans or animals.

2.4 By purchasing from LumiPep, you expressly represent and warrant that:

  • • You are a qualified researcher, scientist, laboratory professional, or academic with legitimate research purposes.
  • • You are at least 18 years of age.
  • • You will use all purchased compounds exclusively for in-vitro laboratory research and will never administer them to any human or animal.
  • • You understand and accept all risks associated with handling research-grade chemical compounds.
  • • You will comply with all applicable federal, state, and local laws, regulations, and institutional policies governing the purchase, possession, storage, and use of research compounds.
  • • You will not resell, redistribute, or transfer any LumiPep products to any person who does not meet these qualifications.

2.5 Any misuse of LumiPep products — including but not limited to human consumption, resale for human use, or administration to animals — is a violation of these Terms and may constitute a violation of federal and state law. LumiPep bears zero liability for any such misuse.

3. Eligibility and Age Requirement

You must be at least 18 years of age to purchase from LumiPep. By placing an order, you represent and warrant that you meet this age requirement. LumiPep reserves the right to refuse service to anyone who cannot verify their age or eligibility.

LumiPep products are intended for purchase and use only by individuals with legitimate scientific research purposes. We reserve the right to request proof of institutional affiliation, research credentials, or other documentation at our sole discretion.

4. Subscription Plans and Billing

4.1 Subscription Tiers: LumiPep offers three monthly subscription tiers: Starter ($79.99/month, 1–2 vials), Researcher ($155.00/month, 5 vials), and Pro Kit ($499.99/month, full research kit). Pricing is subject to change with 30 days' notice to active subscribers.

4.2 Payment: LumiPep currently accepts Cash App ($LumiPepResearch) and Bitcoin (3DhxrbAH6MXTjueALu2hc9qzCKXvTe1oK9). Subscriptions are activated upon confirmed receipt of payment. All prices are in USD.

4.3 Recurring Billing: Monthly subscriptions renew automatically. It is your responsibility to notify LumiPep of your intent to cancel before the next billing cycle. LumiPep is not responsible for charges incurred due to failure to cancel in a timely manner.

4.4 Cancellation: You may cancel your subscription at any time by contacting [email protected]. Cancellations must be received at least 5 business days before the next renewal date to avoid being charged for the upcoming month.

5. Refund and Return Policy

5.1 All Sales Final: Due to the sensitive and perishable nature of research compounds, all sales are final. LumiPep does not accept returns or issue refunds except in the specific circumstances described below.

5.2 Damaged or Incorrect Products: If you receive a product that is demonstrably damaged in transit or materially different from what was ordered, you must contact [email protected] within 48 hours of delivery with photographic evidence. LumiPep will, at its sole discretion, issue a replacement or store credit.

5.3 No Refunds for Misuse: Refunds will not be issued under any circumstances where products have been misused, improperly stored, or used in violation of these Terms.

6. Shipping and Delivery

6.1 LumiPep ships research compounds in secure, discreet packaging with appropriate cold-chain handling where required. Estimated domestic delivery times are 3–7 business days. International shipping timelines vary.

6.2 LumiPep is not responsible for delays caused by shipping carriers, customs, or circumstances beyond our control. Risk of loss passes to the customer upon handoff to the shipping carrier.

6.3 It is the customer's sole responsibility to ensure that the importation and possession of research compounds is legal in their jurisdiction. LumiPep bears no liability for customs seizures, legal consequences, or regulatory actions arising from international shipments.

7. Legal Compliance and Regulatory Notice

7.1 The regulatory status of peptides and research compounds varies significantly by jurisdiction. It is your sole and exclusive responsibility to research, understand, and comply with all laws, regulations, and institutional policies applicable to the purchase, importation, possession, storage, and use of research compounds in your location.

7.2 Some peptides may be classified as controlled substances, prescription drugs, or regulated compounds in certain jurisdictions. LumiPep makes no representations regarding the legality of its products in any specific location outside of their intended research use context.

7.3 LumiPep products are not scheduled substances under the Controlled Substances Act (CSA) and are sold legally as research chemicals. However, laws change frequently, and customers are responsible for staying current with applicable regulations.

7.4 LumiPep reserves the right to refuse or cancel any order if we have reason to believe the products will be used in violation of applicable law or these Terms.

8. Limitation of Liability — CRITICAL

PLEASE READ THIS SECTION CAREFULLY. IT SIGNIFICANTLY AFFECTS YOUR LEGAL RIGHTS.

8.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LUMIPEP, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM OR RELATED TO:

  • • The purchase, possession, use, or misuse of any LumiPep product.
  • • Any personal injury, illness, death, or property damage resulting from use of LumiPep products.
  • • Any legal, regulatory, or criminal consequences arising from the purchase or use of LumiPep products.
  • • Any reliance on information provided on the LumiPep website.
  • • Any failure of the products to meet any particular standard or expectation.

8.2 LumiPep's maximum aggregate liability for any claim arising under these Terms shall not exceed the total amount paid by you to LumiPep in the three (3) months preceding the claim.

8.3 BY PURCHASING FROM LUMIPEP, YOU EXPRESSLY WAIVE ANY AND ALL CLAIMS AGAINST LUMIPEP ARISING FROM THE USE, MISUSE, OR POSSESSION OF ITS PRODUCTS.

9. Indemnification

You agree to indemnify, defend, and hold harmless LumiPep and its owners, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of LumiPep products; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any third-party claims arising from your actions.

10. Intellectual Property

All content on the LumiPep website, including but not limited to text, graphics, logos, images, product descriptions, and software, is the exclusive property of LumiPep and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written consent.

11. Disclaimer of Warranties

LUMIPEP PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. LUMIPEP DOES NOT WARRANT THAT ITS PRODUCTS WILL MEET YOUR SPECIFIC RESEARCH REQUIREMENTS OR THAT THE WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE.

12. Privacy Policy

Your use of LumiPep services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of your information as described in the Privacy Policy.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which LumiPep operates, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or your use of LumiPep services shall first be subject to good-faith negotiation between the parties. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to a jury trial or class action proceeding.

14. Modifications to Terms

LumiPep reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our services after any changes constitutes your acceptance of the updated Terms. We recommend reviewing these Terms periodically.

15. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and LumiPep regarding your use of our services and supersede all prior agreements.
